U.S. EB2 Attorney • National Interest Waivers Visas

The EB2 visa process includes U.S. employers or individuals filing for a national interest waiver, and includes professionals with an advanced degree or exceptional ability in the arts, sciences, or business. These aliens of exceptional ability are considered as a second preference, below those with extraordinary ability who might qualify for EB1 Visas. To qualify for these EB2 employment-based green cards, the visa petition must be filed with:

• a labor certification, which can possibly be waived if the work is considered to be in the national interest, AND

• an official academic record showing a U.S. advanced degree or equivalent foreign degree, and letters from current or former employers showing at least five years of progressive post-baccalaureate experience in the specialty, OR

At least three of the following:

• an official academic record showing a degree or diploma in an area of exceptional ability
• letters from current or former employers validating at least 10 years of full-time experience in the occupation for which the alien is being sought
• evidence of a salary or remuneration for services that demonstrates exceptional ability
• proof of membership in professional associations
• evidence of recognition for achievements and significant contribution to the industry or field by peers, government entities, or professional or business organizations
