October 2015 Visa Bulletin Changes

There is a change to the Department of State’s current system of determining visa eligibility. There are two important dates listed on the monthly Visa Bulletin:
·         The “filing date,” which determines when one can submit their I-485 Adjustment Application, and
·         The “final action” date, which determines when the Department of State or USCIS will adjudicate the I-485 Application.
·         If one has a “priority date” earlier than the listed “filing date” for their particular visa category and country, they are able to file much sooner.  But remember, they will still have to wait for the “final action” date to become current before their permanent residency application will be approved.
·         As a result, those with long priority date backlogs can now receive employment authorization and travel documents while they await final action on their filings.
