Categories for U.S. Family Visas

For an individual family member to be petitioned, they need to fall into one of the following categories:

  • the immediate relative of a U.S. citizen (including widows and widowers who petition within two years of the U.S. citizen’s death, unmarried children under 21 and parents of U.S. citizens over 21)
  • unmarried daughters and sons of U.S. citizens
  • spouses and unmarried children of U.S. citizens and unmarried sons and daughters of green card holders who are over 21
  • married sons and daughters of U.S. citizens
  • brothers and sisters of U.S. citizens

The waiting period for a visa will depend upon the preference category and the country of origin. Some of this information can be accessed on the Visa Bulletin. However, because these laws and regulations are so complex and ever-changing, you should speak with a qualified family member petition attorney. At Ventresca & Ventresca, LLP, we have helped countless families with family visas, and are fully equipped to answer all of your questions on the green card lottery, visa lottery, and diversity lottery.
